Appeals are the process through which a panel of judges review the trail and if "legal errors" are found the appelate judge has the authority to reverse the conviction. About the California Appeals Process

Appeals can be extremely different than trials because while a trial happens in the present and in a court of law, an appeal is carried out by written correspondence. An attorney begins the process by filling a "notice of appeal" with the trial court to begin the preparation of documents. Once the documents are prepared, an appeals attorney will review them looking for any errors that could overturn the conviction. If any irregularities are found the attorney will file "briefs" that will outline the errors made in the case and request an overturn of conviction.

A habeas corpus petition is like an appeal except that it usually concerns information that was not presented at the defendant’s trial. Two of the most common arguments made in a habeas corpus petition are that the defendant’s conviction should be reversed based on “ineffective assistance of counsel” or on “newly discovered evidence.” That is, if there is helpful information that was not discovered at the time of trial or if the defense attorney simply failed to present it, this could be a reason for reversing the defendant’s conviction.
