Man Used Fake Identities on MySpace to Engage in Unlawful Sex with a Minor

24-year-old man was recently arrested by Federal Agents on suspicion of using the Internet to induce a minor to engage in criminal sexual activity.  The defendant had allegedly posed as a 19-year-old boy online in order to contact and arrange a meeting to engage in illegal sexual acts with a 14-year-old girl.

Detectives began investigating the case in August, when they learned through a tip that the 14-year-old Palos Verdes Estates girl had met with the defendant and engaged in sex in her home.  Although the sexual acts were consensual, sexual acts with anyone under the age of 18 is considered Unlawful Sexual Intercourse under California law. 

This offense, also referred to as Unlawful Sexual Intercourse with a Minor, is a wobbler, which means that it can be tried as a felony or a misdemeanor, depending on the circumstances surrounding the case.  If you are more than three years older than the alleged victim, or if you are 21 or older and the alleged victim is 16 or younger, the offense may be charged as a felony.  Since the defendant is over 21 and the victim is under the age of 16, there is a greater chance that he will be facing felony charges.
