Josh McNary, 26, linebacker for the Indianapolis Colts, has been charged
with several felony counts after allegedly raping a 29-year-old female.
The 29-year-old woman disclosed in a rape report that she ended up at
Tiki Bob's, where she met McNary. The two began talking but she started
to feel very intoxicated. When the bar closed, she thought she was still
with McNary but couldn't recall leaving the bar.
The woman found herself at McNary's apartment but did not remember
how she got there. The woman told McNary that she didn't feel well
and said she needed to lie down. After she laid down, McNary began kissing
her and she told him that she was too drunk and that she was not okay
with this. The woman realized she was no longer wearing her pants or underwear
and McNary was now bare-chested. McNary attempted to kiss her neck and
the woman freaked out and tried pushing him away, which made him very upset.
When McNary began to rape her, she started scratching him, told him no
and to stop multiple times and yelled but was unable to move or push him
off of her. When McNary was finished, she retrieved her clothes and asked
him to help her find her phone but McNary refused and told her to spend
the night. The woman found a phone in the living room and grabbed it and
left. The woman contacted the police to report the incident and went to
the hospital for a sexual assault exam that showed she had injuries to
her vagina, dried blood behind her ear and pubic hair that did not belong
to her on her body.
The police traced the cell phone she grabbed from the apartment to McNary
and obtained a search warrant for his apartment. McNary was read his rights
and was taken to the hospital for a suspect assault exam. During the exam,
red abrasions and scratches on his neck, abdomen, shoulder and back were
McNary is charged with one felony count of rape, one felony count of criminal
confinement and one felony count of battery.
