Jason Erpinar allegedly invited an 18-year-old MySpace "friend" to a party where he raped her in a bathroom after she became too intoxicated to resist. Three weeks later he met another 22-year-old MySpace "friend" at a Newport Beach motel. Police have arrested a U.S. Marine Corps recruiter in Riverside County, California, on charges of felony pimping and kidnapping and are looking into whether he used sex with a 14-year-old girl to entice potential recruits.

Staff Sgt. Bryan Damone Cunningham, 33, of San Pedro pleaded not guilty to seven felonies last Thursday after police in Orange discovered the teenage girl in a car with Cunningham and two other men. The two men, ages 18 and 19, were potential Marine recruits, police said.

The girl told police that she met Cunningham online and had sex with all three men. She also told police Cunningham wanted her to work as a prostitute and had tried to take her to Los Angeles County against her will. Police said they are trying to determine if Cunningham may have been using the girl to entice Marine recruits.

Cunningham is being held on $1 million bail and has a court hearing June 18, said John Hall, a spokesman for the Riverside County district attorney's office. The two potential Marine recruits face felony charges on having sex with a minor.

"Sexting" is a new popular trend, but is it a crime?
Posted By Robert Bernstein

The newest teen fad sweeping across the country at the moment has put many teenagers and young adults in life altering positions over the last few months.  This new fad involves sending explicit photos of themselves or other teens via text messaging or email and has been given the term "sexting".  Under both Federal and State criminal law, anyone sending or receiving elicit photos or videos of persons under the age of 18, may be guilty of possession, distribution and production of child pornography, even if they themselves are under the age of 18.

For example, a 15-year-old Pennsylvania girl is facing child pornography charges for sending nude photos of herself to other kids.  A 19-year-old Florida man got thrown out of college and has to register as a sex offender for 25 years because he sent nude pictures of his girlfriend to other teens.  In Alabama, authorities arrested four middle-school students for exchanging nude photos of themselves.  And in Rochester, N.Y., a 16-year-old boy is now facing up to seven years in prison for forwarding a nude photo of a 15-year-old girlfriend to his friends.

Being accused of a sex crime can be a terrifying experience for anyone, let alone teens who are mainly guilty of bad judgment. Child pornography charges may permanently change your life and place your future and freedom at stake.  It takes a truly skilled and experienced criminal attorney to defend a client who is charged with any type of sex crime and achieve the best possible result.

The consequences for a sex crime conviction may range from probation to a lifetime in jail in certain circumstances. Additionally, almost any conviction will include mandatory lifetime sex offender registration, a label that will govern where you are able to live and work. Being labeled a sex offender carries with it serious social consequences - friends, business associates and even family members may no longer want to be involved in your life.

Don't let a conviction for a sex crime ruin your life and destroy your future. If you, or someone you know has been arrested or is under investigation for a sex crime, Contact Los Angeles sex crimes defense lawyer Robert M. Bernstein regarding your case to defend your rights.

  Date Rape Accusations Explained
Posted By Robert Bernstein

Los Angeles Criminal Defense Attorney discusses the accusation of " Date Rape."  The term "Date Rape" is not a legal definition; it is a sexual assault which refers to non-consensual sexual activity between two people who know one another (such as friends, acquaintances, people on a date, etc.) Frequently, drugs and alcohol are a factor in date rape cases, and can cause both the defendant and victim's accounts of the circumstances to be warped or remembered only vaguely.

As a Los Angeles sex crimes defense lawyer, Robert M. Bernstein has the knowledge and experience it takes to defend a client who is facing date rape charges. Often, these accusations are based on a simple misunderstanding, or at times are entirely false and are made with a malicious intent to harm another person. Frequently, hurt feelings or a bitter end to a relationship can lead to these types of false charges. Unfortunately, once the complaining witness makes the allegation to law enforcement officers the case is out of her hands. Overzealous prosecutors may pursue these charges even when the complaining witness has changed, altered, or even recanted her story. This was made very clear recently in the case of three college students at Duke University, who were ultimately cleared of all Rape charges and the prosecuting attorney was disbarred for his unethical prosecution.

Whatever the particular situation, the most important factor in a successful defense is to immediately prepare an aggressive defense strategy. Do not delay, do not wait and think that the truth will eventually come out. Only with the help of an experienced and aggressive defense attorney can you confront these types of charges and clear your name. Attorney Bernstein has achieved extraordinary successes in having numerous of these types of cases dismissed before formal criminal charges are even filed. In the event that criminal charges are filed, Mr. Bernstein has repeatedly been able to have these types of cases dismissed. If you are someone you know is facing these charges contact Mr. Bernstein immediately for a consultation.
