  Supreme Court Modifies Miranda Protections

The United States Supreme Court recently expanded the limits on the famous Miranda rights for criminal suspects.  In a 5-4 decision, the Supreme Court decided that for a suspect to invoke their Miranda rights, they must now verbally assert their right to remain silent in order to stop police interrogations.

This change in the law was triggered by the case of Berghuis v. Thompkins.  Van Chester Thompkins was arrested in 2000 for murder.  Thompkins was read his Miranda rights but refused to sign a form stating that he understood them, or state that he was waiving the rights.  He remained silent through nearly three hours of interrogation, until detectives asked him if he prayed to God asking for forgiveness after shooting the boy. "Yes," was his response, which was the basis for his murder conviction.

On appeal he wanted that statement thrown out because he said he had invoked his Miranda rights by being uncommunicative with the interrogating officers.  The 6th U.S. Circuit Court of Appeals in Cincinnati agreed and threw out his confession and conviction. The high court now reversed that decision.  

Justice Kennedy stated that, "Thompkins did not say that he wanted to remain silent or that he did not want to talk to police.  Had he made either of these simple, unambiguous statements, he would have invoked his 'right to cut off questioning.' Here he did neither, so he did not invoke his right to remain silent."

Based on this ruling, criminal suspects must now affirmatively invoke their right to remain silent in order to stop a police interrogation.  Without this statement, the police may continue questioning a suspect and any statements would be admissible in court.

  Olympic Gold Medalist Shawn Johnson’s Stalker Convicted

In a Los Angeles Superior Court, Robert Michael O'Ryan was charged with one felony count each of stalking and commercial burglary, along with two misdemeanor counts of carrying a loaded firearm in a vehicle.  O'Ryan had driven from Florida to Los Angeles while Shawn Johnson was on Dancing with the Stars in hopes of being able to meet and marry the Olympic gold medal winner.  He was arrested when he tried to jump over a fence at CBS Studios and authorities found a loaded shotgun, knife, and sharpening stone in the suspect's vehicle, along with a wooden club, duct tape, 22 zip ties, a bulletproof vest and love letters to Shawn Johnson.

Judge Pastor found O'Ryan guilty on all counts, however, after considering the evaluations of two psychiatrists, he ruled that O'Ryan was legally insane at the time of his arrest last March.  If found sane, O'Ryan faced up to six years in prison, a sentence he will likely serve in a state mental hospital.

  Actor May Face Death Penalty for Double Murder-for-Profit Plot

Daniel Wozniak, a part-time actor in need of extra cash has been charged in the Orange County Superior Court with two felony counts of murder, with special circumstances of multiple murders and murder for financial gain after he shot and beheaded his neighbor, Samuel Herr.  

Wozniak took Herr's ATM card and his cell phone.  He used the cell phone to summon Herr's girlfriend, Juri Kibuishi, to Herr's apartment via a text message.  Wozniak shot her twice in the head and then removed some of her clothing so police would assume Herr sexually assaulted her, then killed her.  The ATM card was given to a 17-year-old boy who Wozniak used to withdraw $2,000.00 from Herr's account.

  7 Hour Standoff Between Police and Woman with Child Ends

A woman whose identity has not been disclosed was involved in a 7 hour long standoff with Los Angeles police on the morning of July 2. The suspect allegedly fired shots at a nearby liquor store, and then locked herself, a 6 year old child, and a male friend inside an apartment. It is unknown whether she has secured a criminal defense attorney.

The LAPD was called around 2:30 a.m. when the liquor store owner reported the shooting. The apartment in question is located at the intersection of Pickford Street and Highland Avenue in Mid-City.

It was not immediately known whether or not a child was present in the building.  The uncertainty meant that police had to be extremely cautious, according to Commander Andrew Smith. Around 8:30 a.m., 6 hours into the standoff, a 6 year old boy emerged from the building with the suspect's friend.

The suspect surrendered an hour later when police threatened to tear gas the apartment. Police do not know why she initially shot at the liquor store owner. She may be charged with attempted robbery, attempted murder, and resisting arrest.

  Suspected Drug Overdose at Rave Prompts Investigation

A 15 year old girl died last weekend at the Electric Daisy Festival, a two-day music festival and rave at the LA Memorial Coliseum. Sasha Rodriguez, the victim, was apparently on ecstasy, an illegal drug that is popular at raves. According to her friends, Rodriguez passed out and was rushed to the hospital where she fell into a coma. She suffered from respiratory arrest and multiple organ failure. She was removed from life support by her family on Tuesday.

Ectasy can cause strokes, seizures, and kidney failure. Ecstasy overdoses often involve dehydration or overhydration.

Around 185,000 people attended the Los Angeles festival, which was supposed to be a 16-and-older event. Attendees of the rave have reported that no IDs were checked, and that there were many young teenagers present. An investigation is pending and the Coliseum has put a moratorium on rave events.

During the festival, there were over 200 requests for medical attention; 114 people were hospitalized. In addition to drug abuse and overdoses, many people were injured by the crowd. There were 250 police present, and 118 people were arrested, the majority for drug offenses.

  "Ed Rooney" Actor Arrested

Jeffrey Jones, the now 63 year old actor who infamously portrayed Ed Rooney, the principal in Ferris Bueller's Day Off, was arrested again after failing to update his sex offender registration status. He posted $20,000 bail and was released.

He was arrested in 2003 for child pornography possession and for employing a minor to pose for pornographic photos. Both are felony charges. J

ones and his lawyer were able to negotiate a plea bargain in which the child pornography charges were dropped and Jones pleaded no contest to the second charge.

A no contest plea is neither an admission of guilt nor a denial of it; it will, however, result in similar consequences and penalties fo a guilty plea. Jones was required to register as a lifetime sex offender and was sentenced to 5 years probation.

Jones was also arrested in 2004 for failing to update his sex offender registration status.

  Hit-and-run couple get maximum sentence

On March 29, 2009, two USC students, Adrianna Bachan and Marcus Garfinkle, were walking home from a fraternity party when they were struck by a vehicle that failed to stop at a red light at a crosswalk.  Bachan, 18, died from massive head injuries. Garfinkle was carried about 300 feet down the street on the hood of the car but survived with multiple injuries, including two broken legs.  A student who witnessed the crash testified at a court hearing last year that he saw the car's passenger haul Garfinkle's body out of the vehicle's broken windshield while the driver pushed from the inside.  The passenger then dumped Garfinkle onto the sidewalk before the car sped off.

An anonymous tip led to the arrests of Claudia Cabrera, who was driving the car and her husband, Josue Luna, who was the passenger that evening.  Their 7-month-old baby was in the backseat of the vehicle as well.  Cabrera, 31, fled because she had been drinking earlier in the evening and had also had her driver's license suspended and a lawsuit filed against her following a previous collision where she had stopped. 

When Cabrera was arrested she tried to blame the accident on her husband, who was in Mexico at the time.  The authorities found that the pair allegedly tried to cover up the crash by getting the car's windshield fixed before having the vehicle towed to Tijuana, Mexico.  Luna was arrested as he was coming back into the United States about two weeks later but the vehicle was never recovered.

Both plead no contest in March to a felony charge of hit-and-and run resulting in great bodily injury.  Cabrera also plead no contest to a misdemeanor count of vehicular manslaughter.  Judge Robert J. Perry issued a sentence of eight years in prison for Claudia Cabrera, the driver, and seven years for Josue Luna, who was riding in the front passenger seat.

  Police Investigate 3rd Marijuana Dispensary Robbery, Homicide

Last Saturday marked the third shooting in as many days at medical marijuana dispensary in Los Angeles. The shooting was the result of a robbery in which $11,000 was stolen. An employee of the Northridge dispensary was shot in the face and is in critical condition. This is the second time this year that this collective has been involved in an armed robbery and shooting. Two suspects from the first incident are awaiting trial.

The Thursday prior, two separate robberies and shootings occured, killing two people and injuring one. The first dispensary was Higher Path Holistic Care, located in Echo Park. One employee was critically injured and another, 27 year old Matthew Benjamin Butcher, was killed.  According to the surviving victim, four suspects entered the store in the middle of the afternoon, around 4:15 p.m. After robbing the store, they shot both employees. 

Mere hours later, another dispensary, this one in Hollywood, was targeted. Ila Ali Packman was an employee of Hollywood Holistic 2; he was found dead of apparent multiple stab wounds by his employer around 9:00 p.m.

If found, the suspects will likely face charges of grand theft, assault & battery, and homicide.

A new city ordinance took effect in June that orders 439 medical marijuana dispensaries to relocate or close. The ordinance states that dispensaries are no longer allowed to be within 1,000 feet of schools, public libraries, public parks, religious buildings, or another dispensary. It was put into place as an attempt to reduce crime. Most of the dispensaries have closed down; owners of those that remain face $2,500 per day fines and up to 6 months in jail.
